Major Changes to Tenancy Laws Now in Effect Across Queensland

The latest stage of tenancy reform in Queensland has now taken effect, with the Residential Tenancies and Rooming Accommodation and Other Legislation Amendment Act 2024 introducing significant changes for Lessors and Property Managers. Commencing on 1 May 2025, these updates aim to improve transparency and protect tenant privacy. Here’s a quick overview of the most important changes:

Rental Applications:
All applications must now use the official RTA forms—Form 22 for general tenancies and Form R22 for rooming accommodation. At least two submission options must be available, one of which cannot involve a third-party platform or incur a cost for tenants. Only specific personal information can be requested—such as contact details, income verification, and rental history. Importantly, Lessors and agents must not seek information about past legal matters, bond refunds, or detailed bank records.

Privacy & Record Management:
Unsuccessful applications must have their personal data destroyed within three months. For successful applicants, records must be kept for seven years after the tenancy ends, after which they must be securely destroyed.

Property Access:
Notice for property access has increased from 24 to 48 hours. If a Notice to Leave or Intention to Leave has been issued, entry is limited to two times per week unless otherwise agreed.

Financial Disclosure:
Any financial benefit a Lessor or agent receives from payment methods or related services must now be disclosed to tenants.

Tenant Modifications:
Tenants can request to install fixtures or make structural changes using Form 23. Lessors must respond within 28 days and can only decline requests on reasonable grounds.

While these changes were introduced to protect tenants, there are early signs some measures may inadvertently deter applicants. A review may be needed in future reforms.
